The Commissioner for Oaths

Ontario has the Commissioners of taking Affidavits Act which allows people to be appointed as commissioners for oaths. Some people are commissioners for oaths simply by virtue of their office or status. For instance, judges, lawyers, students at law, police officers and notary publics are commissioners for oaths. They are allowed to take and receive affidavits and declarations in Ontario.

Any appointments must be stamped and signed, but a seal is not required. The commissioned documents expire after a period and must be renewed.

Notary Public

On the other hand, a notary public administers & attests oaths, affidavits and affirmations or declarations. The notary public will certify and attest a true copy of a document as well as witness or certify and attest its execution. Notaries will use a stamp and a seal when signing off documents. These documents can then be used in Ontario, throughout Canada and internationally.

When to use a notary public and when to use a commissioner for oaths

This will depend on what type of documents you’re dealing with as well as where the document needs to be used. For instance, if a document is to be used outside of Canada, a notary is required. For instance, a land title deed affidavit will have to be notarized in order to be accepted at the Ontario land titles office.
