Ontario has the Commissioners of taking Affidavits Act which allows people to be appointed as commissioners for oaths. Some people are commissioners for oaths simply by virtue of their office or status. For instance, judges, lawyers, students at law, police officers and notary publics are commissioners for oaths. Any appointments must be stamped and signed, but a seal is not required. The commissioned documents expire after a period and must be renewed.

The notary public will certify and attest a true copy of a document as well as witness or certify and attest its execution. Notaries will use a stamp and a seal when signing off documents. This will depend on what type of documents you’re dealing with as well as where the document needs to be used. For instance, if a document is to be used outside of Canada, a notary is required. For instance, a land title deed affidavit will have to be notarized in order to be accepted at the Ontario land titles office.
